FILING GUIDANCE TO OBTAIN PATENT AND
PETTY PATENT IN LAOS
Requirements for Filing a National Patent/Petty Patent Application in Laos
1. Full Name, Address and Nationality of Applicant(s)
2. Full Name, Address and Nationality of Inventor(s)
3. Country, Application Number, Filing Date of the Basic Application(s) from which the Paris Convention Priority is claimed
4. Original Power of Attorney (POA), which must be duly signed by the applicant(s) and notarized before Notary Public (legalization is not required).
A general POA will be acceptable for various applications in the name of the same applicant.
5. Original Deed of Substitution if the POA does not name Lao IP Agency as the authorized agent, which must be duly signed by the legal representative of applicant(s) and notarized before Notary Public (legalization is not required).
6. English version of the description, claims, abstract and if any, set of drawings
7. Certified copy(ies) of the priority application(s) and the English and Laos translations thereof (if Paris Convention Priority is claimed)
8. Deed of Assignment if the applicant is not the inventor, which must be duly signed by related parties and notarized before Notary Public.
Note:
(i) An original of document 4 must be submitted at the time of filing.
(ii) An original of document 5 must be submitted at the time of filing.
(iii) Document 7 may be submitted up to 3 months from the filing date.
(iv) An original of document 8 must be submitted at the time of filing.
(v) Other following documents should be submitted upon being requested by the Lao Department of Industrial Property (“DIP”) during the application prosecution:
– List of foreign corresponding applications including filing date, filing number, priority dates thereof and, copy of results of any searches or examination, any citations, patent granted for those corresponding applications, if any.
Requirements for Entering Laotian National Phase of a PCT Application
1. Full Name, Address and Nationality of Applicant(s)
2. Full Name, Address and Nationality of Inventor(s);
3. Country, Application Number, Filing Date, Priority date of the Basic Application(s) from which convention priority is claimed
4. English version of the description, claims, abstract and, if any, drawings of the PCT application (the international publication or the original already filed if the PCT application has not yet been published, and any amendment and explanatory statement of the amendment if the application was amended under Article 19 or article 34(2)(b) of the Treaty).
5. Original Power of Attorney (POA), which must be duly signed by the applicant(s)/legal representative of applicant(s) and notarized before Notary Public (legalization is not required).

6. Original Deed of Substitution if the POA does not name Lao IP Agency as the authorized agent, which must be duly signed by the legal representative of applicant(s) and notarized before Notary Public (legalization is not required).
7. Original Deed of Assignment if the applicant is not the inventor, which must be duly signed by related parties and notarized before Notary Public (legalization is not required).
8. Copy(ies) of the priority application(s) and the English and Laos translations thereof
9. Copy of the international search report and the international preliminary examination report and English translation thereof, if any
Note:
(i) The time limit applicable for entering the Lao national phase of a PCT patent application is 30 months counting from the first priority date.
(ii) An original of document 5 must be submitted at the time of filing.
(iii) An original of document 6 must be submitted at the time of filing.
(iv) An original of document 7 must be submitted at the time of filing.
(v) Document 8 may be submitted up to 3 months from the filing date.
(vii) Other documents should be submitted upon requested by the Lao Department of Industrial Property (“DIP”) during the application prosecution:
– List of foreign corresponding applications including filing date, filing number, priority dates thereof and, copy of results of any searches or examination, any citations, patent granted for those corresponding applications, if any.
